Virginia Tax Refund

Option 1: If you don't owe Virginia income tax and don't expect a refund, you don't need to file a VA tax extension. If you expect a refund, you must file a VA tax return to receive it.

Option 2: Your accepted federal extension will also extend your Virginia tax filing deadline, as long as you don't owe Virginia income tax or expect a refund. There's no need to file a separate Virginia extension Form 760IP.

Owe Virginia Taxes

Option 1: Pay all or some of your Virginia income taxes online via: Payment Form 760IP.

Option 2: If you owe Virginia income tax, you must file a VA tax return or extension by the deadline to avoid late filing penalties. You can only e-file a federal extension, not a Virginia extension. A federal extension will only delay penalties until October.
Note: Unless you pay all your Taxes or eFile your tax return by the October deadline, the late filing penalties will start again after that deadline.

Tax Penalties
Important: If you owe Virginia and/or IRS income taxes and do not file an IRS and Virginia tax return or extension by the Tax Due Date, you will be subject to IRS and VA late filing penalties. Estimate IRS late filing, payment penalties. In addition, if you do not pay your taxes by the Tax deadline, you will be subject to late tax payment penalties. Filing an extension on time will ONLY eliminate the late filing penalties but not the late tax payment penalties. Late filing penalties are generally higher than late payment penalties, thus file something on time even if you can't pay anything on time!

The late filing penalty is 6% of the amount due, calculated from the original due date of your tax return. This penalty applies for each month or partial month that the amount remains unpaid, after accounting for any payments or credits made by the original due date. The maximum penalty is capped at 30% of the total amount due.  An additional amount of 10% of interest is charged per year for unpaid tax.
